1. INITIAL INFORMATION
Please read carefully the following general terms and conditions (hereinafter “Terms”) regulating registration at www.alakarte.cz (hereinafter “ALAKARTE.CZ Pages”) and table reservations in partner restaurants (hereinafter “Reservation(s)” or “Reservation services”). By accepting the Terms you also confirm that you have read them, understood them, have no objections to them and have consented to them; The Terms form a binding contract between you and ALAKARTE s.r.o., corporate ID: 289 93 063, with registered office Prague 5, Hlubočepy, V Bokách III 257/5, postal code 15200 Prague, entered in the Commercial Register of the Municipal Court of Prague, C 158483 (hereinafter “ALAKARTE.CZ”). By submitting a registration form at the ALAKARTE.CZ Pages, you accept the Terms. The contractual relationship established by the Terms regulating your use of ALAKARTE.CZ services is valid during the term of your registration at the ALAKARTE.CZ Pages.
2. REGISTRATION AT THE ALAKARTE.CZ PAGES
The use of ALAKARTE.CZ Reservation services is limited to individuals over 18 years old and is conditioned by registration at the ALAKARTE.CZ Pages. A person can register based on an invitation of an already registered ALAKARTE.CZ Member. When completing the registration form, each person will be asked to enter their first and last name, email address, telephone and code of the invitation. Registration is free of charge. Upon successful registration, a confirmation email will be sent to the email address indicated on the registration form.
3. ALAKARTE.CZ RESERVATION SERVICES AND THEIR BENEFITS
3.1. Benefits
Only a duly registered Member (hereinafter “Member(s)”) can use Reservation services via ALAKARTE.CZ Pages. Reservation services provide Members with a simple and quick way of making reservations in partner restaurants listed on ALAKARTE.CZ Pages (hereinafter “Partner restaurants”) via a single point of contact and with the possibility to use the benefits offered by some Partner restaurants. The benefits consist of various discounts or bonuses indicated on a particular Reservation form (e.g. % discounts on meals and beverages, 2 for 1 offers when the more expensive item is charged, free beverage or dessert with main course, etc.; hereinafter “Benefit(s)”). The specific Benefit is indicated on each Reservation form and is subjected to prior electronic Reservation at the ALAKARTE.CZ Pages. Use of Benefits may be limited depending on the actual conditions of the Partner restaurant (please see section “Restrictions”).
NOTE: NOT ALL PARTNER RESTAURANTS OFFER BENEFITS IN CONNECTION WITH A RESERVATION – INFORMATION ON WHETHER A PARTICULAR PARTNER RESTAURANT OFFERS BENEFITS AND THE TYPE OF BENEFITS ARE PROVIDED ON THE RESERVATION FORM OF EACH PARTER RESTAURANT.
3.2. Make a Reservation
Reservations can be made as follows:
- Step 1: The Member selects a Partner restaurant from the list on the ALAKARTE.CZ Pages by clicking on the selected Partner restaurant and its Reservation form.
- Step 2: Member enters the number of persons, date and time of Reservation. Member chooses one of Bonuses available on the menu or decides to make Reservation without any Bonuses
- Step 3: ALAKARTE.CZ subsequently confirms the Reservation to the Member by email. It is not necessary to print and submit the confirmed Reservation in the Partner restaurant in order to use the specific Benefits.
NOTE: The use of ALAKARTE.CZ Benefits in selected Partner restaurants that offer such Benefits is conditioned upon the Member making a prior electronic Reservation at the ALAKARTE.CZ Pages, using a Reservation form. Member may make Reservation by phone at the telephone number provided on ALAKARTE.CZ Page in the Contact section. In this event, ALAKARTE.CZ will fill in the reservation form for Member. If Member fails to enter a valid telephone number or email when registering on ALAKARTE.CZ Website, ALAKARTE.CZ reserves the right not to make Reservation.
Reservations made during working hours will be processed by ALAKARTE.CZ within 10 minutes of receiving the request at Reservations; requests sent after working hours will be processed by 11:30 the following day. ALAKARTE.CZ is open every day, including weekends and holidays, with working hours published in the Contact section. Two hours before the time of Reservation ALAKARTE.CZ will send an email to Member with a reminder of the approaching Reservation. One hour after Reservation ALAKARTE.CZ will send Member an email with a request to review Partner Restaurant.
3.3. Validity and cancelation of the Reservation
The Benefit can be used only during the day indicated and confirmed as the Reservation date on the Reservation form. The Reservation is transferable, i.e. the Reservation and the potential Benefits connected with the Reservation can be used by persons other than the Member provided that the Reservation is made under the name under which the Member is registered at the ALAKARTE.CZ Pages. The Reservation and potential Benefits connected with such Reservation can be used only once. A completed Reservation can be canceled only through the web pages of ALAKARTE.CZ in the My Alakarte/My reservation section or by calling ALAKARTE.CZ at the telephone number in the Contact section, no later than the time of the Reservation. Failing to abide by these rules for canceling a reservation is grounds for ALAKARTE.CZ to deduct points (see paragraph 4 below); repeated failure is grounds for terminating Membership Account (see paragraph 11 below).
4. ALAKARTE.CZ POINTS
Each Member receives points for his/her ALAKARTE.CZ account for (a), a completed (not canceled) Reservation, (b) review published on ALAKARTE.CZ Pages and (c) completed (not canceled) Reservation made by friends registered at his/her invitation. Member receives ALAKARTE.CZ points exclusively for Reservation made electronically via the reservation form on ALAKARTE.CZ Pages; points are not awarded for Reservation made by telephone (i.e. the electronic reservation is made for Member by an ALAKARTE.CZ employee). After a certain number of ALAKARTE.CZ points have been accumulated, they can be exchanged for any of the Bonuses currently offered on ALAKARTE.CZ Pages. Points cannot be exchanged for money.
Points for making Reservation will be activated, i.e. credited to Member Account within 24 hours after visiting Partner Restaurant. Member is also awarded points for sending friends an electronic invitation to register at ALAKARTE.CZ, which can be requested on the web pages of ALAKARTE.CZ. Each invitation comes in the form of an email with a link that can be forwarded to friends. If the invited friend clicks on this link, registers on ALAKARTE.CZ Pages and makes a first Reservation, Member who invited that person receives ALAKARTE.CZ points for that Reservation.
If Member makes Reservation but does not use it nor cancels it in time (in accordance with paragraph 3.3 above), Member Account, as a penalty, is deducted twice the points that would have been awarded for Reservation. This does not affect the right of ALAKARTE.CZ to close Member Account for repeated failure to use Reservation without making a proper cancellation on time (see paragraph 11 below).
Details about receiving and using ALAKARTE.CZ points, such as the number of points awarded for each activity and the current number of points in Member Account, are available on ALAKARTE.CZ Pages.
5. VOUCHERS
5.1 Purchasing a gift voucher
Each Member can order a gift voucher for Partner Restaurants that offer this option. Gift vouchers can also be ordered by logging on at ALAKARTE.CZ Website, going to the section My Alakarte, where the current price of vouchers is available, and completing the appropriate form. Gift vouchers will be sent to Member by registered mail to the postal address which Member provided and which is automatically saved to his/her profile. Member can change the address in the section My Alakarte. After the order is sent, Member receives a request for payment. Payment is only possible by transfer to the account of ALAKARTE.CZ, no. 2102544227/2700. Member will be sent the printed gift voucher by post after payment is credited to the account of ALAKARTE.CZ. ALAKARTE.CZ does not charge postage or other fees for sending gift vouchers, only the price of the voucher. An unlimited number of gift vouchers can be purchased at one time.
Each gift voucher has a unique code that can be used only once. The gift voucher can only be redeemed for Reservation at Partner Restaurant made by Member registered on ALAKARTE.CZ Pages by entering the unique code of the gift voucher in the reservation form. After verifying the validity of the gift voucher code, Member completes Reservation. ALAKARTE.CZ will then confirm Reservation by sending Member a message to his/her registered email address. Member is required to turn in the printed gift voucher at Partner Restaurant.
5.2 Exchanging ALAKARTE.CZ points for vouchers
Vouchers can also be obtained in exchange for points accumulated in an ALAKARTE.CZ account. If there are a sufficient number of ALAKARTE.CZ points in an ALAKARTE.CZ account, Member can exchange these points for a voucher on the reservation form. The minimum number of points for a voucher is always listed under What is Alakarte/Bonus program. The voucher thus obtained can then be used by Member only for Reservation at Partner Restaurant that accepts such vouchers. The value of the voucher will be deducted from Member’s total bill at Partner Restaurant. Only active points can be exchanged for the voucher, i.e. points credited to Member Account at the time of the exchange.
5.3. Restrictions on gift vouchers and vouchers received in exchange for ALAKARTE.CZ points
Restrictions on the gift voucher: The gift voucher is good for 6 months after its issue. ALAKARTE.CZ points cannot be used to order a gift voucher (paragraph 5.1).
Restrictions on both types of vouchers: Vouchers can be used only in those Partner Restaurants where it says in their profile, “ALAKARTE.CZ vouchers accepted” – it should be noted that not all Partner Restaurants accept ALAKARTE.CZ vouchers. The list of Partner Restaurants that accept ALAKARTE.CZ vouchers can be found in the section About Alakarte/Bonus program. In the event that Member makes Reservation and would like to use a voucher but fails to reach Partner Restaurant in time and Member did not properly cancel Reservation in time (in accordance with paragraph 3.3 above), the voucher is forfeited. The value of the voucher cannot be exchanged for cash. Member is not entitled to a refund or exchange of points for expired vouchers.
6. RESTRICTIONS
An individual may register on ALAKARTE.CZ Pages only once using a valid email address and telephone number. The Benefits connected with a Reservation cannot be combined, i.e. a person can only apply one ALAKARTE.CZ Benefit (e.g. only one % discount, one 2 in 1 discount) per one visit at a Partner restaurant; limitations as to the maximum number of people allowed to use the Benefit connected with a Reservation are indicated on each Reservation form. If no limitations are expressly listed on the Reservation form, the Benefit connected to such Reservation can be used by an unlimited number of people. The use of an ALAKARTE.CZ Benefit in conjunction with other discounts or bonuses is at the sole discretion of the Partner restaurant – Benefits may not be available, for example, in combination with loyalty cards or special offers (such as the daily lunch menu, brunch, etc.) or may not be available on certain days such as Valentine’s Day, Christmas Eve, Christmas Day, New Year’s Eve, New Years’ Day, etc. All such restrictions and limitations are at the sole discretion of the Partner restaurant. Each Partner restaurant is also entitled to refuse to provide the Benefits due to full capacity or if it is closed to the public due to exclusivity. The Partner restaurant may also change its menu and offers at its sole discretion.
ALAKARTE.CZ reserves the right to terminate at any time any registration at the ALAKARTE.CZ Pages of any Member and to prevent such Member from using Reservations and Benefits connected therewith if the Member makes Reservations without showing up at the Partner restaurant, as well as in case of other breaches of the Terms and Conditions. It is not deemed a breach of Terms and Conditions if the Member duly cancels the Reservation made at a Partner restaurant in advance through the ALAKARTE.CZ Pages.
7. PARTNER RESTAURANTS
By agreement with ALAKARTE.CZ, Partner restaurants are obliged to accept Reservations, and some Partner restaurants also to provide Benefits, to all ALAKARTE.CZ Member who make a valid Reservation. The current list of Partner restaurants is published at the ALAKARTE.CZ Pages and is updated regularly. The Partner restaurants are entitled to terminate the contractual relationship with ALAKARTE.CZ at any time and to change the Benefits they provide and ALAKARTE.CZ is not obliged to inform Members about such changes.
8. REVIEWING RESTAURANTS
Each Member can review any Partner Restaurant he/she visits, within 6 months from the date of completing Reservation. The current rating of Partner Restaurant on ALAKARTE.CZ Pages is always based on the mean value (i.e. average value) of all reviews shown. At the end of the calendar year, the company ALAKARTE.CZ publishes the final assessment under About Alakarte/Restaurant reviews based on the mean value of all published reviews of all Partner Restaurants, which were assessed during the course of the year by at least 10 Members; the minimum number of Members providing reviews may change over time, while the current number is always published on ALAKARTE.CZ Pages. Reviewed Partner Restaurants will also receive from ALAKARTE.CZ a sticker with the number of stars (1 to 5 stars, with 5 indicating the highest possible rating).
For their reviews on ALAKARTE.CZ Pages, Members receive their own “ranking” in accordance with the number of reviews they make, i.e. Nibbler (1 review) Grazer (2-3 reviews) Foodie (4-7 reviews), Gourmet (8-25 reviews), and Gastronaut (26 + reviews), with Member rising in rank as his/her number of reviews grows. The assessment of each Member carries the same weight.
Member can choose Nickname/Nick for submitting reviews. Partner Restaurants are entitled to respond to these assessments (and ALAKARTE.CZ may publish the answer on ALAKARTE.CZ Pages), in which case Member is informed of this response by email and will have the chance to respond as well. ALAKARTE.CZ reserves the right to delete any review by Member that is suspected of being based on a fictional reservation or if the review contains any profanity.
9. LIABILITY
Partner restaurants provide Reservations and Benefits connected with the Reservations based on contractual relationships with ALAKARTE.CZ. ALAKARTE.CZ is not liable for the performance of individual Partner restaurants. Any complaints must be addressed directly to the particular Partner restaurant. ALAKARTE.CZ provides no warranty and has no responsibility for any potential disputes or claims between the Members of or persons using the Reservations and the Partner restaurant. ALAKARTE.CZ reserves the right to change the scope of or to cancel Benefits without the prior knowledge and consent of Members. Up to date information is published at the ALAKARTE.CZ Pages.
10. PERSONAL INFORMATION
By submitting a registration form at the ALAKARTE.CZ Pages, the Members agrees that ALAKARTE.CZ may include the Member in the list of Members that it maintains in connection with providing Reservation services. The Memberr thereby also gives his/her consent to ALAKARTE.CZ processing the contact information (first name, last name, telephone number, email address) provided to ALAKARTE.CZ upon registration at the ALAKARTE.CZ Pages, for the purposes of being contacted by ALAKARTE.CZ (including in the context of consumer contests) and for receiving offers of services and products, information and special offers from ALAKARTE.CZ or its business partners. The consent is provided for the period of the Member being registered at the ALAKARTE.CZ Pages. The provision of such personal information is voluntary. The Member can unsubscribe from receiving commercial communication at any time, using kancelar@alakarte.cz or by simply responding to such message upon receiving it. The Member’s personal information will be processed and used solely by ALAKARTE.CZ. Special offers will be sent to the Member’s email address or the Member profile at the ALAKARTE.CZ Pages. ALAKARTE.CZ will not provide or make otherwise accessible to third parties personal information provided by Member under the Terms and Conditions. The Member is entitled to access personal information that he/she has provided, to have his/her personal data changed, to request an explanation from ALAKARTE.CZ and to request that ALAKARTE.CZ remedies any breach (e.g. by blocking, correcting, supplementing or deleting a Member’s personal information) if the Member finds or presumes that ALAKARTE.CZ is processing the Member’s personal information in violation of protecting the Member’s private and personal life or in contradiction with the law (in particular if the personal information is inaccurate with respect to the purpose of processing it); the Member also has the right to contact the Office for the Protection of Personal Information in case his/her rights are violated.
11. TERMINATION OF REGISTRATION
Member may cancel his/her registration on ALAKARTE.CZ Website at any time without giving a reason by sending an e-mail to kancelar@alakarte.cz. ALAKARTE.CZ may terminate the registration of any Member at any time without further notice if it is reasonably believed that Member is violating these Terms and Conditions. ALAKARTE.CZ reserves the right to terminate the registration of any Member on ALAKARTE.CZ Website and prevent the use of Reservation and Bonuses associated with it, especially in the case where Member has repeatedly made Reservation without using it in Partner Restaurant. Member properly canceling a completed Reservation before the time of Reservation through ALAKARTE.CZ Page (see paragraph 3.3 above) is not considered a violation of these Terms and Conditions.
ALAKARTE.CZ also reserves the right to terminate Membership Registration especially in cases when Member tries to obtain ALAKARTE.CZ points in a questionable manner; is registered under an email address and/or phone number no longer in use; or has been inactive for more than 18 months/no Reservation made.
In the event that ALAKARTE.CZ terminates Membership Account, Member will not be compensated for any ALAKARTE.CZ points.
12. LINKS TO OTHER WEBSITES
ALAKARTE.CZ is not responsible for the functionality or content of external websites, the links to which are published at the ALAKARTE.CZ Pages. ALAKARTE.CZ is also not responsible for the protection of data and information on such external websites which are not protected by ALAKARTE.CZ security measures.
13. THE CONTENT OF ALAKARTE PAGES
ALAKARTE.CZ strives to ensure that all information published at the ALAKARTE.CZ Pages is up to date and accurate at all times. However, minor errors or inaccuracies may occur and for which ALAKARTE.CZ apologizes. All content published at the ALAKARTE.CZ Pages is owned solely by ALAKARTE.CZ; all rights are reserved. Material and texts displayed at the ALAKARTE.CZ Pages may be modified, published or otherwise distributed only with the prior permission of ALAKARTE.CZ. ALAKARTE.CZ reserves the right to change and modify the ALAKARTE.CZ Pages at its convenience, without prior notice. All changes in the Terms and Conditions become effective 7 days after being published at the ALAKARTE.CZ Pages. If the Member disagrees with any change in the Terms and Conditions, he/she can cancel his/her registration immediately.
14. FEEDBACK
ALAKARTE.CZ appreciates the opinions and feedback provided by Members. Opinions and suggestions regarding the Partner restaurant experience or ALAKARTE.CZ Pages can be sent to kancelar@alakarte.cz. ALAKARTE.CZ reserves the right to quote all submissions received, with or without disclosing the name of the Member providing the submission, at its sole discretion.
